1. Acceptance of Terms
Welcome to NexerDoc. By accessing or using our website, mobile application, or telehealth services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform or services.
NexerDoc is a telehealth platform that provides access to Licensed Medical Oversight from board-certified medical professionals. Our services are delivered by licensed physicians, nurse practitioners, and physician assistants who are authorized to practice in the states where services are rendered.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be a legal resident of the United States
- Reside in a state where our licensed medical professionals are authorized to practice
- Provide accurate, complete, and current information during registration
- Not have any medical condition that contraindicates the use of semaglutide or related medications
- Have the legal capacity to enter into binding contracts
3. Medical Services
3.1 Licensed Medical Oversight
NexerDoc provides access to healthcare services through Licensed Medical Oversight. Our medical team consists of board-certified physicians, licensed nurse practitioners, and licensed physician assistants. All clinical decisions are made by licensed medical professionals who are fully credentialed and authorized to practice medicine in their respective jurisdictions.
By using our services, you acknowledge that:
- A licensed medical professional will review your medical history and determine whether treatment is appropriate for you
- All prescriptions are issued at the discretion of our licensed medical professionals
- Our licensed professionals may decline to prescribe medication if they determine it is not medically appropriate
- Telehealth consultations may not be suitable for all medical conditions or emergencies
- In case of a medical emergency, you should call 911 immediately
2.2 No Guarantee of Results
While our licensed medical professionals provide evidence-based treatment plans, individual results vary. We do not guarantee specific weight loss outcomes. Our commitment is to provide quality medical oversight and support throughout your treatment journey.
4. Prescription Medications
4.1 Prescription Process
Our licensed medical professionals evaluate each patient individually. If a prescription is deemed appropriate, it will be issued by a licensed provider and sent to our partner pharmacy for fulfillment. All medications are dispensed only upon receipt of a valid prescription from an authorized prescriber.
4.2 Medication Risks
Semaglutide and related medications carry potential risks and side effects. Our licensed medical professionals will discuss these with you during consultation. You are responsible for:
- Disclosing your complete medical history and current medications
- Reporting any adverse effects promptly
- Following the prescribed dosage and administration instructions
- Attending follow-up consultations as recommended
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:
- Provide accurate and truthful information
- Update your information promptly when changes occur
- Notify us immediately of any unauthorized account access
- Not share your account with others
- Not use the Platform for any illegal or unauthorized purpose
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Payments and Pricing
6.1 Fees
You agree to pay all fees associated with the services you select. Fees include consultation fees, medication costs, and shipping charges as displayed at the time of purchase. All prices are in U.S. dollars and are subject to applicable taxes.
6.2 Subscription Plans
If you select a subscription plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription according to our Refund Policy. We reserve the right to change pricing with notice to you.
6.3 Payment Method
We accept major credit cards and debit cards. By providing payment information, you represent that you are authorized to use the payment method. Payment processing is handled by PCI-compliant third-party processors.
7. Shipping and Fulfillment
Medications are shipped by our partner pharmacy using temperature-controlled packaging. Shipping times vary based on location. We are not responsible for delays caused by the shipping carrier or circumstances beyond our control. You must provide a valid shipping address where an adult 21 or older can receive the delivery.
8. Cancellations and Refunds
Our Refund Policy, available at nexerdoc.com/refund, is incorporated into these Terms by reference. We offer a 30-day refund window for eligible orders as described in that policy.
9. Telehealth Informed Consent
By using our Platform, you provide informed consent for telehealth services. You acknowledge that:
- Telehealth involves the delivery of healthcare services using electronic communication
- Our licensed medical professionals use telehealth to evaluate, diagnose, and treat you
- Telehealth has potential limitations including technical failures and data transmission issues
- Alternative in-person care options are available
- Emergency care is not provided through the Platform
10. Intellectual Property
All content on the Platform, including text, graphics, logos, images, software, and design, is the property of NexerDoc or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.
11. Prohibited Conduct
You agree not to:
- Use the Platform for any fraudulent or unlawful purpose
- Impersonate any person or entity
- Interfere with the security or functionality of the Platform
- Attempt to access another user's account
- Submit false or misleading information
- Use automated tools to access or scrape the Platform
- Violate any applicable law or regulation
12. Limitation of Liability
To the maximum extent permitted by applicable law, NexerDoc, its officers, directors, employees, agents, and licensed medical professionals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform or services. This includes, but is not limited to, damages for loss of profits, data, or goodwill.
Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you have paid to us in the twelve months preceding the claim.
13. Disclaimer of Warranties
The Platform and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
Notwithstanding the foregoing, clinical services provided by our licensed medical professionals are delivered in accordance with applicable standards of medical care. Our medical team is committed to providing quality healthcare; however, we cannot guarantee specific medical outcomes.
14. Indemnification
You agree to indemnify and hold harmless NexerDoc, its licensed medical professionals, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms or your use of the Platform.
15. Termination
We reserve the right to terminate or suspend your access to the Platform at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Platform will immediately cease. Sections relating to payments, intellectual property, limitation of liability, disclaimer of warranties, indemnification, and governing law shall survive termination.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
17. Dispute Resolution
Any dispute arising from these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. You agree to arbitration on an individual basis; class actions are not permitted.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice on the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, HIPAA Notice, and Refund Policy, constitute the entire agreement between you and NexerDoc regarding your use of the Platform and services.
